Terms of Service
The agreement between the academy and the parent or guardian booking lessons.

This is a starting point written to fit how the academy actually operates, not legal advice. It needs review by a qualified lawyer before launch, particularly the sections on children's data, which fall under three different regimes at once (UK GDPR, US state law and COPPA, and Nigeria's NDPA). 1. These terms
These terms govern the tutoring services provided by Excel Innovation Academy, operated by[Legal entity name] of [Registered address]. By booking an assessment, a trial lesson or a course of lessons, you agree to them.
Because our students are usually children, this agreement is with the parent or guardian, not with the student. If you are booking for someone under 18, you confirm you have the authority to do so and accept these terms on their behalf. Students aged 18 or over may contract with us directly.
2. What we provide
We provide live, scheduled one-to-one and small-group tutoring in academic subjects, digital skills and examination preparation, delivered over Microsoft Teams. Each engagement normally begins with a free academic assessment and a free trial lesson, so that both sides can judge the fit before any money changes hands.
We also provide a written progress report each month for every active student.
3. Tutor matching
We match each student to a tutor based on the assessment, the subject and the curriculum being followed. Tutors are subject-tested and observed teaching before they are assigned.
We may need to substitute a tutor through illness, availability or because the match is not working. We will tell you before a substitution wherever we can, and you may ask for a different tutor at any time without giving a reason.
4. Scheduling and time zones
Lessons are scheduled in your local time zone and stay in that slot. If a clock change or a move shifts your local time, tell us and we will re-anchor the schedule rather than expect you to adapt.
5. Cancellation and missed lessons
- You cancel or reschedule with at least 24hours notice: the lesson is moved at no charge.
- Less than 24 hours notice, or the student does not attend: the lesson is treated as delivered and charged.
- We cancel, for any reason: the lesson is rescheduled at your convenience or credited in full. This includes a tutor failing to appear or a connection failure at our end.
We understand that children get ill and that power and connectivity are not always within your control. Talk to us, because we would rather move a lesson than charge for one nobody attended.
6. Fees and payment
We charge competitive hourly rates, with custom packages available on request. Rates are confirmed in writing before any paid lesson takes place, and will not change during a package you have already paid for.
We accept upfront payment in NGN, USD and EUR. Payments are processed by[payment provider]. Where a currency conversion applies, the rate is the one applied by that provider at the time of payment.
Refunds. [Refund policy to confirm. For example, unused lessons in a prepaid package are refundable pro rata within 60 days of purchase.]
7. Your responsibilities
- Provide a reliable internet connection and a device able to run Microsoft Teams.
- Make sure the student is ready and present at the scheduled time.
- Give us accurate information about the student's level, curriculum and goals.
- Tell us about any learning need or accommodation that would help us teach well.
8. Conduct and safeguarding
Lessons are a safe, respectful space. We will end a lesson, and may end the engagement, where a student or an adult behaves abusively toward a tutor. The same standard binds our tutors, absolutely, in the other direction.
Tutors may not contact a student outside our scheduled sessions and channels. If a tutor contacts your child privately, tell us immediately atexcelinnovation1@gmail.com.

9. Teaching materials
Worksheets, notes and other materials we provide remain ours, and are licensed to you for the student's personal study. Please do not redistribute or resell them. Work the student produces belongs to the student.
10. What we do not promise
We are confident in our teaching and proud of our results, but no tutor can guarantee an examination grade. Outcomes depend on the student's effort, starting point and the examination itself. Nothing on our website or in our communications should be read as a promise of a particular grade, a place at a particular university, or any other specific result.
11. Liability
We are responsible for providing our services with reasonable care and skill. Where we fail to do so, our liability to you is limited to the fees you have paid us in the[twelve] months before the problem arose.
We do not exclude or limit liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot lawfully be excluded. Nothing in these terms affects a consumer's statutory rights.
12. Ending the arrangement
You may stop lessons at any time by telling us in writing. Any unused prepaid lessons are handled under clause 6. We may end the arrangement where fees go unpaid after a reminder, or where clause 8 has been breached.
13. Changes to these terms
We may update these terms. Where a change affects lessons you have already paid for, the terms you agreed at the time of purchase continue to apply.
14. Governing law
These terms are governed by the laws of [Nigeria], and disputes fall to its courts. If you are a consumer in the UK or the EEA, this does not deprive you of the protection of the mandatory consumer law of the country where you live.
